Catfish lawsuit over music rights could expose plot hoax

We reviewed Catfish at the London Film Festival. Then we reviewed it in America and ABC did an investigation on the matter. Then we did a whole feature about it. Surely the claims that the movie’s plot is a hoax have been put to rest, right?

Surprisingly the one loose strand that may be the Schulman brothers’ undoing and cause the whole thing to unravel is a licensing issue over one of the songs used in the story. If the movie is indeed a documentary and completely factual, then their use of Amy Kuney’s All Downhill From Here song is completely fine thanks to fair use laws.

However, if it actually is a hoax then they no longer have that extended right. Apparently Threshold Media — which owns Spin Move Records — thinks this is a bet worth taking, and has filed a lawsuit against Universal and Relativity Media. It sure is a funny way to put the truth to the test, though it will most likely settle out of court leaving us to forever wonder about the movie’s reality.
